ELECTION RULES AND GUIDELINES

1. Date of Election: JULY 12, 2026

2. Venue: Almiya Subdivision, Riverside, Canduman, Mandaue City 

3. Time: 8:30AM-5:00PM

4. Number of Directors to be Elected: Seven (7)

5. Validation of Proxies. In the validation of proxies, any member may be represented by a proxy in all the meetings of the ALMIYA HOMEOWNERS ASSOCIATION, INC. The proxy can opt to delegate his representation to another good standing vecino. Members are requested to submit on or before June 21, 2026, their respective proxies through the PROXY FORM or a printed copy available at Admin Office.

6. Qualification of Nominees to the Board

Nominees to the Board are required to be:

6.1 a member of good standing;

6.2 of good moral character;

6.3 not have been convicted by final judgment of an offense punishable by imprisonment for a period exceeding six (6) years prior to the date of election; and

6.4 has not been cited for any violation of the Deed of Restrictions, as amended and supplemented, the By-laws and rules and regulations of the Association.

 

7. Nominations

7.1 All nominations can be done through a Google form or a printed form available in the office. 

7.2 Period of Filing Nominations: All nominations must be submitted no later than May 15, 2026 at 11:59 p.m. to the –

Clubhouse, Almiya Subdivision, Riverside, Canduman, Mandaue City

 

7.3 The list of official candidates will be released at the official Facebook group and through email on July 1, 2026.


8.0 Requirement of Curriculum Vitae

8.1 Each official candidate shall submit the “Letter of Acceptance” to the Administration Office (at the address given above) with his/her curriculum vitae and recent picture (1x1). The curriculum vitae submitted by the official candidates shall serve as guide to the voters in their assessment of the qualifications of the candidates.

8.2 Each official candidate is likewise required to submit his/her platforms of government and plans for the Association.

8.3 The curriculum vitae of the qualified candidates shall be posted at the Almiya site, official Facebook group and through email.

 

9.0 Manner of Voting

9.1 The election will be conducted hybrid (onsite and online) via Google Meet. All attendees need to confirm their confirmation form if they will attend onsite or online. 

9.2 Election will be July 12, 2026

9.3 A good standing member shall be entitled with one (1) vote per lot owner. All vecinos who paid their Q1 2026 Association Dues and water fee dues until June 30, 2026 are considered good standing member.

9.4 Delinquents’ vote will not be counted. Delinquent members are those who failed to pay  their Q1 2026 Association Dues and water fee dues until June 30, 2026.

9.5 Additional votes will be added to the person who is appointed as proxy by the good standing member. Proxy form signed by the unit owner and the proxy must be submitted to the office to be acknowledged.

9.6 Member shall cast their votes through the polling feature of Google Forms.

9.7 A good standing member may volunteer to be a member of the Election Committee (ELECOM) who shall conduct the voting and counting of votes. The member of the ELECOM must not be a candidate of Election.

9.8 Counting of votes shall commence when the ELECOM closes the voting.


10. Quorum

A quorum is needed for the Association to competently decide on the matters enumerated in the Agenda of Notice of the Annual Membership Meeting.

 

Article IX, Section 5 of the Association’s By-Laws provides:

“Majority of the members in good standing present in person or by proxy shall constitute a quorum, in accordance with the provision as stated in the Almiya Covenant at any meeting of the of the member s for the transaction of business”

 

11. Duties of the Board of Directors of Almiya 

From By-Laws Of Almiya Homeowners Association - Article V - Board Of Directors Or Trustees. The Board of Directors of Almiya holds significant responsibilities and powers to ensure the smooth operation and management of the association. Their general duties, unless otherwise specified in the articles of incorporation and by-laws, include:

11.1 Accounting and Financial Oversight: Maintain an accounting system in accordance with generally accepted accounting principles. Keep detailed books of accounts, accessible for inspection by any homeowner and authorized government representatives upon request, during reasonable business hours.

11.2 Fee Collection: Collect reasonable fees, dues, and assessments as outlined in the by-laws and approved by the majority of the members.

11.3 Enforcement of Payments and Rules: Collect reasonable charges for assessments. Impose fines for late payments and by-law violations after due notice and hearing, following the procedures and regulations adopted by the board.

11.4 Financial Management: Propose measures to manage funds and manage the utilization of such funds, submitting proposals for the consideration of association members.

11.5 Orientation and Training: Undergo orientation by the DHSUD or another competent agency within thirty (30) days after election or appointment. This orientation covers meeting conduct, preparation of minutes, handling accounts, and understanding relevant laws and regulations.

11.6 Adherence to By-laws: Fulfill the duties and responsibilities as specified in the association's by-laws.

11.7 Exercise of Powers: Exercise other necessary and proper powers in accordance with the governing Act and for achieving the association’s objectives. 

These duties ensure that the Board of Directors of Almiya manages the association effectively, maintaining transparency, financial responsibility, and compliance with relevant laws and regulations.
